Draft — not yet published, and not legal advice. I am not a lawyer and this has not been reviewed by one. It is written to be accurate about what the software does and fair to both sides, which is a good starting point for a lawyer to shorten rather than a substitute for one. Fill in each PLACEHOLDER. If you will charge chambers, have someone review sections 4 and 9 in particular.

Terms of Service

Last updated: DATE

These terms are between you and LEGAL ENTITY NAME ("we", "us"), who operate this event tracking service.

1. Who these apply to 2. Accounts 3. If you run an event 4. Fees 5. What you publish 6. Acceptable use 7. The live tracking is best effort 8. Availability 9. Liability 10. Ending it 11. Changes 12. Governing law

1. Who these apply to

Three kinds of people use this service, and the terms apply differently to each. Spectators watch an event and need no account. Participants run one entry in an event — a float, a vendor stall, a hunt stop. Organizers are the chamber, committee or business running an event. Using the service in any of these ways means you accept these terms.

2. Accounts

3. If you run an event

You are the publisher of your event, and that carries real obligations:

4. Fees

STATE YOUR PRICING HERE. At minimum this section should say what an event costs, what is included, when payment is due, whether it renews, and your refund position if an event is cancelled — weather being the obvious case for outdoor events. If the service is free while you pilot it, say that and say that you will give notice before charging. Our recommendation: 30 days' written notice before any price change, and no change to the price of an event already paid for.

5. What you publish

You keep ownership of everything you upload — your photos, your descriptions, your logo. By uploading it you give us permission to store it and show it to the people your event is for, which is the only way the service can work. That permission ends when you delete the content or your event, apart from copies in routine backups that roll off within 30 days.

Only upload what you have the right to upload. We can remove content that breaches these terms or somebody else's rights, and we will tell the organizer when we do.

6. Acceptable use

Do not use the service to harass anybody, publish unlawful or deceptive content, impersonate a person or organization, interfere with its operation, attempt to reach data that is not yours, or scrape it at a scale that degrades it for others. Do not use location sharing to follow a person rather than an event entry.

7. The live tracking is best effort

This matters more than the usual boilerplate, so it has its own section. Positions, arrival times and "up next" estimates depend on phone GPS, mobile coverage at a crowded event, and participants remembering to check in. They are estimates and they will sometimes be wrong.

Do not rely on them for anything safety-critical. They are not a substitute for marshals, road closures, emergency planning or your own eyes. Decisions about the safe running of your event are yours, and we are not a party to them.

8. Availability

We aim to keep the service running, particularly on event days, but we do not promise it will be uninterrupted. It depends on hosting, mapping and network providers we do not control. We will give reasonable notice of planned maintenance and will avoid scheduling it near an event we know about. IF YOU OFFER AN UPTIME COMMITMENT, STATE IT HERE.

9. Liability

The service is provided "as is". To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost profits, or loss arising from inaccurate tracking data or from the service being unavailable. Where liability cannot be excluded, it is limited to THE GREATER OF THE FEES YOU PAID US IN THE PAST 12 MONTHS, OR $100.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

10. Ending it

You can stop using the service at any time and ask us to delete your account. An organizer can delete their event, which removes its entries and data. We can suspend or end access if these terms are breached — we will tell you why, and other than in serious cases we will give you a chance to put it right first. If we discontinue the service entirely we will give AT LEAST 60 DAYS' notice and a way to export your data.

11. Changes

We may update these terms. If a change materially affects you we will give notice before it takes effect — our recommendation is 30 days — and continuing to use the service after that means you accept the change.

12. Governing law

These terms are governed by the laws of STATE, and the courts of COUNTY, STATE have jurisdiction. Nothing here removes any protection consumer law in your own area gives you.
